Is virtual witnessing of Wills legal and valid?

Yes, the virtual signing and witnessing of a Will and Power of Attorney is legal and permitted under the following laws:

  • Ontario Succession Law Reform Act and Substitute Decisions Act (as amended in May 2021)
  • British Columbia Ministerial Order M161 and M162
  • Alberta Personal Directives Act (PDA), Powers of Attorney Act (PAA) and Wills and Succession Act (WSA)

What is virtual witnessing?

Virtual witnessing allows an NotaryPro notary public and a second witness provided by NotaryPro to watch you physically sign your documents while on a video call.

After booking your appointment, please print a copy of your Last Will and/or Power of Attorney. Grab a pen and your ID, and then join the video call at the scheduled time.

How does it work?

Our virtual witnessing service is convenient, secure and online. All you need to do is upload or email us your document(s), pick a convenient time and date, and pay. Once your appointment is booked, you will receive a confirmation email with all essential details and a video call link. Try it now!

Do I need to bring a witness? Does NotaryPro provide a witness?

NotaryPro will provide you with a second witness to sign your Will and Power of Attorney while on the online video call.

NotaryPro’s notary public will serve as the first witness (as a licensed legal professional) in accordance with Ontario and BC law.

All Wills and Power of Attorneys must be signed by two witnesses to be valid in Canada.

I signed my Will. Now what do I do?

The law currently requires physical “wet ink” signatures on the original document (Will or Power of Attorney).

After you physically sign your Will, NotaryPro and the additional witness will physically sign their counterpart copy.

Once signed, NotaryPro will mail or courier the signed witness copy of the Will back to you. Keep and store both the original and the signed witness copies.

I'm in BC. Can Notary Pro sign my will and Power of Attorney?

At this time, for Wills and Power of Attorneys, Notary Pro is only able to serve clients located in Ontario and is offered only by licensed Ontario Notary Publics.

We are planning to be able to serve clients located throughout Canada very soon.
